Terms of Service


Last updated: 20 July 2026 · These Terms of Service ("Terms") are a binding agreement between you and the operator of demo-tape.net ("demo-tape", "we", "us"). The service is operated by a private individual (not a company), who can be contacted at [email protected]. By accessing or using the platform you accept these Terms in full. If you do not agree, do not use the service.

1. The service

demo-tape is a hosting and discovery platform for user-submitted music (demos, edits, remixes, original works). We provide the infrastructure; all content is created, uploaded and published by users, who remain solely responsible for it. demo-tape does not pre-screen, endorse or claim ownership of user content. Your privacy is covered by our Privacy Policy and Cookie Policy.

2. Accounts

You must provide accurate information and keep your credentials secure; you are responsible for all activity under your account. Accounts registered as record labels are subject to manual review. We may suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

3. Your content and licence to us

You retain all rights in the content you upload. By uploading, you grant demo-tape a non-exclusive, worldwide, royalty-free licence to host, store, transcode, generate waveforms/previews of, display and stream that content solely for operating and promoting the platform. You can terminate this licence for a given work at any time by deleting it.

4. Your responsibilities and warranties

You represent and warrant that (a) you own or control all rights in the content you upload, or hold all licences, permissions and consents necessary for its publication and for the grant of the licence above — including, for remixes, edits, bootlegs and mashups, any required authorisation from the rights holders of the underlying works; (b) your content does not infringe any third-party right (copyright, trademark, personality, privacy or otherwise) and does not violate any applicable law; (c) you will not upload malware, spam, or unlawful material. You bear full and exclusive legal responsibility for what you upload.

5. Hosting provider safe harbour & takedown

demo-tape acts as a mere technical intermediary (hosting provider) for user content. We do not monitor content proactively and have no general obligation to do so. Upon receipt of a sufficiently substantiated notice of infringement (see Report copyright), we act expeditiously to remove or disable access to the material. Repeat infringers are terminated. Counter-notices are accepted and forwarded where applicable.

6. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY OR RELIABILITY. YOU USE THE PLATFORM AT YOUR OWN RISK. We do not guarantee that content is lawful, licensed, accurate or safe, nor that the service will be uninterrupted, secure or error-free, nor that stored content will not be lost.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEMO-TAPE, ITS OPERATOR, AFFILIATES AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, NOR FOR LOSS OF PROFITS, DATA, GOODWILL OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY USER CONTENT — WHETHER IN CONTRACT, TORT OR OTHERWISE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) EUR 50. Nothing in these Terms excludes liability that cannot be excluded by law (e.g. wilful misconduct or gross negligence where non-excludable).

8. Indemnification

You agree to indemnify, defend and hold harmless demo-tape and its operator from and against any claim, demand, damages, losses and expenses (including reasonable legal fees) arising out of or related to your content, your use of the service, or your breach of these Terms — including any third-party claim that content you uploaded infringes their rights.

9. Acceptable use

No unlawful, defamatory, hateful or harassing content or conduct; no impersonation; no scraping, automated bulk access, rate-limit evasion or interference with the service; no artificial inflation of plays, supports or followers; no distribution of malware. Downloads are governed by the per-track permissions set by uploaders — obtaining audio outside those permissions is prohibited.

10. Subscriptions & paid plans

demo-tape offers optional plan tiers (Basic, Pro, Unlimited) that raise upload limits and help cover infrastructure costs; the Free tier is the default for everyone. Self-service paid checkout is not currently available: tiers are assigned manually by the operator on request, so at present there is no automatic card billing, subscription auto-renewal or online payment through the platform. If and when self-service paid plans become available, the applicable prices, billing cycle, renewal terms and any right of withdrawal/refund (including the statutory consumer withdrawal right, where it applies) will be presented and agreed at checkout and will supplement these Terms. Nothing here obliges us to keep any given tier, price or limit unchanged.

11. Content removal, suspension, termination

We may remove content, restrict features or terminate accounts at any time, with or without cause or notice, including to comply with law or protect the platform, its users or third parties. You may delete your content or account at any time; sections 4, 6, 7, 8 and 13 survive termination.

12. Changes

We may amend these Terms and/or the service at any time. Material changes are announced on the platform; continued use after the effective date constitutes acceptance.

13. Governing law & venue

These Terms are governed by Italian law and, where applicable, by European Union law, without regard to conflict-of-law rules and without prejudice to the mandatory consumer protections of your country of residence, where these apply. Exclusive venue for disputes is the competent court of the operator's place of establishment in Italy; where you qualify as a consumer, any court competent for your place of residence or domicile within the EU remains available if the law so provides.

14. Miscellanea

If a provision is held invalid, the remainder stays in force. Failure to enforce a right is not a waiver. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and demo-tape regarding the service.
